Privacy and Cookies Policy

Campaign Tester conducts market research to help our Clients improve their web content and online advertising. Our proprietary software is used to track facial features of people who choose to participate in our campaign studies and to analyze their emotional response to on-screen media.

In this Privacy and Cookie Policy (“Policy”), we describe how we collect, use, and disclose Personal Information (defined in a later section) that we obtain about visitors, participants, and clients that interact with us through campaigntester.com (the “Site”), participants through our mobile Application (“App”) and Clients that license or purchase our software and services available through our Site (collectively, the “Services”), and how we use and disclose that information.

We use cookies on our Site. Insofar as those cookies are not strictly necessary to provide our Site and Services, we will ask you to consent to the use of cookies when you first visit our website.

Please read this Privacy and Cookies Policy carefully. By visiting the Site, downloading or using the App, or using any of our Services, you agree that your Personal Information will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. Campaign Tester’s Terms of Service are incorporated by reference into this Policy. When you participate in one of our campaigns and/or use our Site or Services, you are agreeing to this Policy.

Are Children Allowed to Use Campaign Tester?
At this time, our products and services are intended for purchase and use by adults only. We do not knowingly collect personal information from children under the age of 13 without the consent of the child's parent or guardian. Should we discover that any data has been collected from a participant under the age of 18, without the required consent, we will immediately delete it. If you believe we have collected a child’s information please notify us and, if after investigation your belief proves true, we will delete the data pursuant to the laws governing the collection of such data.

Safeguarding your privacy is of the utmost importance to us.

  • Campaign Tester has a strict opt-in research policy. We only collect campaign data (including facial recordings) from participants who have given their explicit consent by allowing access to their webcam prior to each media viewing session.


  • Any Personal Information that we collect from you will be treated as confidential through the implementation of security measures.

Security of Personal Information

We have implemented commercially reasonable precautions to protect the data we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security.

We enter into confidentiality and data processing agreements with service providers to ensure they comply with best practices in privacy and security standards. We regularly review these standards and practices.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that no one else knows or can easily guess, and keeping your login and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

What does Personal Information mean?

Personal Information means anything that can be used to identify you, including but not limited to, your email address, biometric data such as the facial recordings that we collect when you participate in a campaign, IP addresses, location information or information that we collect from your use of our Site or Services.

If you do not agree with this Privacy Policy, please do not purchase or participate in Campaign Tester market research campaigns or use our Site.

We refer to “you” a lot in this Privacy Policy. To better understand what information is most relevant to you, see the following useful definitions.

Clients
You have registered for an account with Campaign Tester and you either uploaded a video and provided a proposed subject group by uploading an email list and/or phone list where you have validly collected consent from the proposed participants to contact them for this purpose, within an account.

Participants
You have downloaded the App or otherwise agree to view Video campaigns sent to you by Campaign Testers on behalf of the creators, our Clients.

Website Visitor
You’re just browsing the site and haven’t yet created an account, downloaded the App or participated in a Campaign.

What Data Do We Collect and Why?

Campaign Tester is a market testing tool and service used for market research and to gauge participants’ emotional response to on-screen media. We analyze these responses to assist our clients in improving their content and advertising. We collect data about you in three ways: 1) directly from you, 2) from third parties, and 3) through your usage of our Site or Services.

Information We Collect Directly From You. Certain areas and features of our Site and Services require registration. To register you must provide your email address and mobile number.

Campaign Tester verifies your engagement with the campaign and Services by utilizing the camera on your smartphone or other camera-enabled device to collect biometric data such as locating your face and related features that may include your eyes, nose and other micro facial gestures. We do this to detect your engagement by: 1) monitoring that you are able to watch each video, in its entirety and 2) your emotional responses while viewing the campaign. Access to your camera is required in order to participate in a campaign.

Information We Collect From Third Parties If Campaign Tester has invited you to participate it is because a client has provided your email address and attested that they validly collected your contact information and consent to do so. We may also obtain data about you from publicly available information or trusted third party service providers where, for example, you give permission to those third parties to share your information with us or where you have made that information publicly available online.

Information We Collect Automatically We may automatically collect the following information about your use of our Site or Services through cookies, web beacons, and other technologies: your domain name; your service provider; your browser type and operating system; device type and timestamp; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; and the referring URL, or the webpage that led you to our Site, and the following: access time, browser type, device ID, domain name, IP address, page views and referring URL. We also may collect the following information about your use of the App: mobile device ID; location and language information; device name and model; operating system type, name, and version; your activities within the App; and the length of time that you are logged into our App. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

Account Information

Registration information
Before you can use Campaign Tester Services, you must register for an account, at which time we collect your first and last name, username, password and email address. If you choose to register by using a third party account (such as your Google or Facebook account), please see “Information from third parties” below.

Billing information
We utilize PCI compliant third-party service providers to process billing payments. When you make a purchase, you must provide your billing details, a name, address, email address and financial information corresponding to your selected method of payment (e.g. a credit card number and expiration date or a bank account number). If you provide a billing address, we will regard that as the location of the account holder to determine which Campaign Tester the sales tax, if applicable, to be applied to your purchase.

Account settings
You can set various preferences and personal details on pages like your account settings page. For example, your default language, time zone and communication preferences (e.g. opting in or out of receiving direct marketing or advertising messages from Campaign Tester.

Use of some of our services will also result in us collecting the following data on your behalf:

Prospective Participant email address information.
We may allow you to import or upload contact information such as email addresses, phone numbers, lists containing the same so you can easily invite people to view your Campaigns. We don’t use this data for our own purposes or contact anyone, except at your direction.

Campaign or application data.
We store your Campaign and App data for you and provide analysis tools for you to use with respect to this data.

Profile information.

When you sign up for our services you may be asked to provide us with information about yourself and to give us more detailed insights into who you are.

How We Use Your Information

We use your information, including your personal information, for the following purposes:

  • To provide and improve our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, fulfill your requests, and for other customer service purposes.
  • To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Site, App, or our Services.
  • For marketing and promotional purposes. For example, if you have consented, we may use your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you.
  • To better understand how users access and use our Site and Services, both on an aggregated and individualized basis, in order to improve our Site and Services and respond to user desires and preferences, and for other research and analytical purposes.
  • To provide third-party or client offers.

How We Share Your Information

We may share your information, including personal information, as follows:

Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which Jinglz is involved.
Aggregate and De-Identified Information. We may share aggregate or de-identified information about users with our clients and third parties for marketing, advertising, research or similar purposes.

Personal Information Retention
We store Personal Information for as long as it is required for our research and business purposes and as required by law. When Personal Information is no longer required or you have not interacted with us for three years (whichever occurs first), we will delete it from our systems.

Cookie Policy
We and our third-party service providers use cookies and other tracking mechanisms to track data about your use of our Site, App, or Services. We may combine this information with other personal data we collect from you (and our third-party service providers may do so on our behalf).
Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies).

Cookies

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Visitors to our Site who disable cookies will be able to browse certain areas of the Site, but some features may not function.

Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for your decision to click on those links, purchase their products or services, or the data and privacy practices of such third-party websites.

Cross Border Transfer of Data

Campaign Tester is owned and operated in the United States of America. As such you information may be disclosed in the United States and in countries in which our servers, third-party service providers are located, We do this for data management and business purposes, in particular, for outsourced data processing by organizations on our behalf and in accordance with the stated aim of the data processing. We take appropriate steps to ensure your information is adequately protected. If you do not agree to the cross border transfer of information, please do not use our services.

Your Rights

You may have certain legal rights to obtain information about whether we hold personal information about them, to access personal information we hold about them, and to obtain its correction, update, amendment or deletion in appropriate circumstances. Some of these rights may be subject to some exceptions or limitations. We will respond to your request to exercise these rights within a reasonable time (and in all cases within 30 days of receiving a request).

Access To Personal Data

Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.

Opting Out Of Direct Marketing

With your prior consent, we may send periodic promotional or informational emails to you. You may withdraw your consent to direct marketing through your account or opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

If you are located in the European Economic Area and you are dissatisfied with how we have managed a complaint you have submitted to us, you have the right to contact your local data protection supervisory authority.

Changes to this Policy

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on our Site, at www.campaigntester.com/privacypolicy. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site, or sending a notification to the email address used to register your account.
